Protecting Indigenous Traditional Knowledge Through a Holistic Principle-Based Approach

This article examines the legal complexity concerning protection of traditional knowledge (TK) held by Indigenous Peoples. Despite significance this knowledge, particularly environmental conservation, biodiversity management, bioresources, and ecosystem management in connection with lands on which Peoples live, current frameworks fall short offering a comprehensive regime respectful key ethical principles that are central for Peoples, mainly fairness, right to culture, Peoples’ self-determination (IPRSD). To map currently available solutions offered protecting TK rights, primarily three regimes – intellectual property rights (IPR), human but also looks at some national solutions. However, none these per se offers suitable solution, each suffers from various shortcomings, as we demonstrate detail. Yet if developed further, along others would indeed be mechanisms protection. Accordingly, suggests principle-based approach accessing amalgamates concepts private exclusivity via mainstreaming values, such fairness associated IPRSD holistically, throughout multiple layers decision-making.
